These terms and conditions describe an agreement between gameserverator.com and every registered user (hereinafter referred to as "user") of the gameserverator.com platform and the associated services, such as a game server (hereinafter referred to as "server"). User name, email address and a strong password are required for registration.

The term "gameserverator.com", "us" and "we" refer to the owner of this platform, Marco Strauss.

The services offered by gameserverator.com are defined by the rental of game servers, which are available to registered users for a fee.

The platform and all related services are usually available 24 hours a day. However, there may be interruptions in availability due to planned maintenance or unplanned events. Scheduled maintenance usually takes place between 3 a.m. and 6 a.m. A guarantee for the error-free operation of the platform is technically impossible, which is why we do not accept any responsibility for errors of any kind.

We always strive to ensure that all data on the services offered are stored correctly and are available at all times. However, there may be failures in the transmission, storage, retrieval or operation of the services, which result in a partial or complete loss of data. We do not accept any liability for lost data or damage resulting from it. You are responsible for creating data backups with the resources we have made available.

Furthermore, the availability of the platform is also dependent on external influences, such as the user's Internet connection. We are not responsible for any disruptions in this area.

Billing takes place per service session (hereinafter referred to as "session") and is clocked every minute. A session is a period in which a service (e.g. game server) is available to the user for active use. This also includes, for example, the game server startup phase and the controlled shutdown / stopping and persistence of user data. The specified start / stop phases can vary over time due to certain server settings or installed mods.

The "initialization" of a session is not billed. This phase is usually marked for the user.

Our services are paid for by adding credit (hereinafter referred to as "credits") to the user account. Various payment methods are available to the user. The services cannot be used without sufficient credits. The available credits can be viewed in the area "Payment".

The user can cancel any purchase within 14 days without giving reasons, provided that the corresponding amount of credits is still available in the user account. For this, the user can request a refund to the support team: support@gameserverator.com. Refunds are generally made minus fees that were incurred when purchasing with a specific payment provider from the seller (here gameserverator.com). Apart from that, credits that are added to the user account are non-refundable and cannot be exchanged for the currency chosen by the user.

User name, email address and a strong password are required to create a user account. The user must provide the data requested in the registration form completely and correctly. Registration with third-party or otherwise inaccurate information is prohibited. The personal password is stored in encrypted form by gameserverator.com. If the user loses his password, he must create a new password using the appropriate form.

As far as permissible under applicable law, the user declares that he is responsible for all activities that are carried out with his user account.

We reserve the right to withhold access to our platform and our services from the user and to close the user account immediately without giving reasons. This applies in particular to a violation of applicable law or our terms of service. In this case, it is not possible to release data.

Furthermore, we reserve the right to access the user account and all associated data and services at any time and without notice in order to change or remove them.

The user undertakes to use the services provided by gameserverator.com only for the intended purpose and to comply with all applicable laws. Misappropriating our services or circumventing the technical restrictions and limitations used is prohibited. Likewise, a disproportionate burden on the resources provided is to be avoided.

Serious misuse such as attacks against the infrastructure of our platform or third parties (e.g. carrying out DDoS attacks or harmful program code), fraud or other activities relevant to criminal law can be reported.

We reserve the right to delete user accounts and all associated data immediately in the event of violations.

The user has the option of installing third-party content (software, mods, plugins, add-ons, etc.) via the platform or uploading them himself. We cannot guarantee the functionality, topicality and security of the content provided and, in particular, the content uploaded by us. We cannot offer any support for this content either.

For the content installed or uploaded by the user, he must be able to guarantee that it comes from trustworthy sources and that the user takes into account and complies with all relevant rights of third parties.

If you have any questions or problems about the user account or our services, please contact our support (support@gameserverator.com), who will try to help you with relevant problems. As a rule, it can take up to 24 hours for the user to receive an answer. In rare cases it can take longer or the user does not receive any answer.

Especially with questions that do not directly concern our platform, but e.g. content such as plugins or mods from third-party providers, our support can probably not help. In such cases, we recommend looking for a solution yourself or contacting support for the relevant content.

We reserve the right to make changes to our platform and our services, including these terms of use, at any time.

If one of the conditions mentioned here is held to be ineffective, void or for any reason unenforceable, this provision is deemed severable and does not affect the validity and enforceability of any remaining provisions. Should this occur, the meaning and purpose of the provision should be replaced by another legally permissible provision.

We are not obliged to participate in a dispute settlement procedure before a consumer arbitration board and do not take part in such a procedure. Gameserverator.com informs users that the EU Commission has set up an internet platform for online settlement of disputes ("OS platform") between entrepreneurs and consumers in accordance with Directive 2013/11/EU.
